Agreement to Terms

By accessing or using the website at designwithmike.com or engaging any services provided by Design With Mike you agree to be bound by these Terms of Service. If you do not agree to these terms please do not use our website or services. These terms apply to all visitors, clients, and anyone else who interacts with our business.

Services Provided

Design With Mike offers digital marketing and creative services including but not limited to website design and development, search engine optimization, paid advertising management, social media content creation, video production, and custom software and application development. The specific scope of work, deliverables, timeline, and pricing for any engagement will be outlined in a separate project agreement or proposal provided to the client prior to work beginning.

Free Mockup Offer

Our "Free Mockup" offer is provided as a complimentary, no-obligation service to demonstrate our design capabilities. By submitting a request, you agree that any mockups, designs, or concepts created by Design With Mike remain our exclusive intellectual property unless a formal project agreement is signed and paid for. We reserve the right to decline mockup requests at our discretion, and there is no guaranteed delivery timeframe, though we aim for 24-48 hours.

Client Responsibilities

Clients agree to provide accurate and complete information necessary for Design With Mike to perform the requested services. This includes timely feedback, approvals, content, credentials, and access to platforms as needed. Delays caused by the client may affect project timelines and Design With Mike cannot be held responsible for missed deadlines resulting from incomplete or late client input.

Payment Terms

Payment terms are outlined in each individual project proposal or agreement. Unless otherwise specified a deposit is required before work begins and the remaining balance is due upon project completion or as outlined in the payment schedule provided. Late payments may result in a pause of work until the balance is brought current. Design With Mike reserves the right to charge a late fee on overdue balances.

Intellectual Property

Upon receipt of full payment clients receive ownership of the final deliverables created specifically for their project including logos, website design, and custom content. Design With Mike retains the right to display completed work in our portfolio and marketing materials unless the client requests otherwise in writing. Any pre-existing tools, frameworks, templates, or proprietary processes used in the creation of your project remain the property of Design With Mike.

Revisions & Scope Changes

Project proposals include a defined number of revision rounds. Requests that fall outside the agreed scope of work may be subject to additional fees. Design With Mike will communicate any scope changes and associated costs before proceeding with work beyond the original agreement.

Third-Party Platforms & Tools

Some services involve the use of third-party platforms such as Google Ads, Meta, social media networks, email marketing tools, and website hosting providers. Design With Mike is not responsible for changes, outages, policy updates, or pricing adjustments made by these third-party providers. Clients are responsible for maintaining their own accounts and ensuring continued access.

SMS Communications

By providing your phone number and opting in to receive text messages from Design With Mike you consent to receive project updates, appointment reminders, and occasional service-related communications via SMS. You can opt out at any time by replying STOP. Message and data rates may apply. We comply with all A2P 10DLC regulations governing business text messaging in the United States.

Confidentiality

Design With Mike treats all client information, business strategies, and project details as confidential. We will not share your proprietary information with outside parties without your consent except as required to deliver your services or as required by law. Clients agree to treat any proprietary processes, pricing, or methods shared by Design With Mike as confidential as well.

Limitation of Liability

Design With Mike is not liable for indirect, incidental, or consequential damages arising from the use of our services or website. Our total liability for any claim related to our services will not exceed the total amount paid by the client for the specific service in question. We do not guarantee specific results from SEO, paid advertising, or social media campaigns as outcomes depend on many factors outside our control.

No Guarantee of Results

Digital marketing results vary based on market conditions, competition, budget, and other factors beyond our control. Design With Mike will apply our full expertise and effort to every engagement but we cannot guarantee specific rankings, leads, revenue, or return on ad spend. Past results from other clients do not guarantee similar outcomes.

Termination

Either party may terminate a service agreement with written notice as outlined in the individual project contract. In the event of termination the client is responsible for payment of all work completed up to the termination date. Design With Mike reserves the right to terminate services immediately if a client engages in abusive behavior, requests illegal work, or violates these terms.

Governing Law

These terms are governed by the laws of the State of Texas. Any disputes arising from these terms or our services will be resolved in the courts of Hidalgo County, Texas.

Changes to These Terms

We may update these Terms of Service periodically. Changes will be posted on this page with an updated date. Continued use of our website or services after changes are posted constitutes your acceptance of the updated terms.
